Civil Process

Lawsuit paperwork.

Pursuant to Missouri statute, the Sheriff's Office is the primary law enforcement agency responsible for serving various forms of civil process. Generally, this process includes the personal service of civil and/or criminal court documents. These documents are typically filed with the Circuit Clerk's Office and then transferred to the Sheriff's Office for service. Court filings may include land disputes, divorces, garnishments, executions, subpoenas, and other legal matters. The Sheriff's Office serves between 1,000 and 1,500 documents each year.

The Sheriff's Office is also tasked with serving civil process related to landlord and tenant disputes. The Office generally serves notices of eviction or tenancy. The Missouri Attorney General's Office provides a landlord/tenant booklet that outlines the basic legal rights and responsibilities of both landlords and tenants. A copy of this booklet is available through the Sheriff's Office, or it can be requested directly from the Missouri Attorney General's website.

The Sheriff's Office is also responsible for serving various Orders of Protection. This includes both child and adult protection orders, which are obtained through the Circuit Clerk's Office.

The Sheriff's Office collects a $35.00 service fee, along with an applicable mileage fee, for most civil process services. This fee does not apply to Orders of Protection or criminal matters.
